This website is operated by JAG GAME AND MARINE. Throughout this site, the terms “we,” “us,” and “our” refer to JAG GAME AND MARINE. By using our site and services, including making purchases, you agree to the terms outlined below (“Terms and Conditions” or “Terms”). These Terms apply to all users, including browsers, customers, vendors, and contributors.

General

  • By using the website or services, you agree to these Terms.
  • These Terms are governed by the laws of Queensland, Australia.
  • We may update these Terms at any time. Continued use of the website constitutes acceptance of any changes.
  • We may refuse service to anyone at any time. Reproduction of content requires written permission.
  • You may not use the site or its content for unlawful purposes.

1. Online Store Terms

  • Users must be at least 18 years old or have parental consent.
  • Purchases must comply with local laws. You assume full legal responsibility for owning items purchased.

2. Products and Services

  • Returns and exchanges are governed by our Return Policy.
  • Product images and colors may not be exact.
  • We may change products, pricing, or availability at any time.
  • Orders may be limited or refused.
  • Account and purchase details must be accurate and updated as needed.

3. Payment Terms

  • Online purchases must be paid in full at the time of sale.
  • No layby is available for online orders.

4. Layby Policy (In-Store/Phone Orders)

  • Deposit: 25%
  • Fortnightly payments of ~25% over 6 weeks
  • Cancellations incur a 25% fee
  • Admin fee: $45 incl. GST
  • Unpaid laybys after 6 weeks are forfeited
  • Free storage for 6 weeks; after that, $6.50/week per firearm/order
  • Title passes only after full payment

5. Cancellations (Paid in Full)

  • Cancellations within 4 weeks incur a 25% restocking fee; thereafter, no refunds
  • Admin fee: $45 incl. GST
  • Items not picked up after 4 weeks may be resold
  • Special orders are non-refundable
  • Backorder cancellations incur an admin fee

6. Transfer of Ownership

Firearm ownership passes only after:

  • Valid Permit to Acquire is presented
  • Compliance with the Weapons Act 1990
  • Full payment is received

7. Returns & Refunds

  • Original receipt required
  • Items must be unused, undamaged, and in original packaging
  • No returns for change of mind
  • Claims must be made within 30 days
  • Special orders are non-refundable

8. Product Warranties

  • New Products: Manufacturer warranties apply; misuse or unauthorized repairs void warranty. Firearms covered only with factory ammunition.
  • Used Optics: Warranty only if manufacturer provides a lifetime warranty; misuse or unauthorized repairs void warranty.

9. Errors and Omissions

Our site may contain inaccuracies or omissions. We reserve the right to correct these at any time, even after an order is placed.

10. Third-Party Tools and Links

We may offer tools and links provided by third parties. We do not control these and are not liable for their content or performance. Use them at your own risk.

11. User Content and Submissions

  • You grant us a license to use any content you submit (feedback, suggestions, etc.) without compensation.
  • We may monitor or remove content that violates these Terms.
  • Your personal data is handled according to our Privacy Policy.

12. Disclaimer

  • Our services and products are provided “as is” without warranties of any kind.
  • We are not liable for indirect or incidental damages arising from use of services or products.
  • You agree to indemnify JAG GAME AND MARINE from claims arising from your use of services or violation of Terms.
  • If any part of these Terms is invalid, the rest remains in effect.
  • Terms remain in effect until terminated by either party; outstanding payments still apply.

13. Entire Agreement

These Terms constitute the full agreement between you and JAG GAME AND MARINE regarding your use of the Service.
